Borrow Agreement

By entering into this Borrow Agreement, you (the "Borrower") agree to the terms and conditions outlined below for the borrowing of garments from Simply Borrowed Dresses LLC.

1. Borrow Return and Condition

The Borrower is responsible for ensuring the timely return of all borrows on or before the agreed-upon return date. All borrows must be returned in good and wearable condition.

2. Good/Wearable Condition

"Good/wearable condition" is defined as having no tears, rips, unremovable stains, missing buttons, hooks, clasps, or closures.

3. Minor Damages

If a borrow is returned with minor fixable damages, the Borrower will be subject to a service fee of 20% of the borrow price for necessary repairs.

4. Heavily Stained Borrows

Should a borrow be returned with significant staining or large stains that cannot be professionally removed, the Borrower will be responsible for purchasing the damaged borrowed garment at 150% of its retail value.

5. Unwearable Condition

If a borrow is not returned in good/wearable condition, the Borrower will be liable for purchasing the damaged borrowed garment at 150% of its retail value.

6. Payment and Pickup

The Borrower is required to pay the total borrowing fee for all garments at the time of pickup or upon placing an order online.

7. Late Return Fee

A late fee of $25 per day will be applied for each dress that has not been postmarked and tracked by the agreed-upon return date.

8. Borrower Eligibility

The Borrower must be at least 18 years of age or older, or have a parent or guardian place the order on their behalf.

9. Liability Waiver

The Borrower acknowledges and agrees that Simply Borrowed Dresses LLC shall not be held liable for any injuries, accidents, damages, or incidents that may occur while wearing a borrowed dress. The Borrower assumes all responsibility and risk associated with wearing and using the borrowed garment, and hereby releases Simply Borrowed Dresses LLC from any liability.

By proceeding with your borrow order, you acknowledge that you have read, understood, and agreed to abide by the terms and conditions set forth in this Borrow Agreement, including the liability waiver. Failure to comply with these terms may result in additional charges and potential legal actions.
